Terms of Service

1. Acceptance of Terms
By creating an account or using the BuilderCam mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of a company or other organisation, you represent that you have authority to bind that organisation to these Terms.
2. The Service
BuilderCam is a software-as-a-service platform that enables contractors and tradespeople to:
- Record video and audio walkthroughs of job sites
- Automatically generate AI-powered Statements of Work (SOW) from those recordings
- Send, manage, and obtain e-signatures on SOW documents
- Manage jobs, teams, and client communications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable to you or any third party for any such changes.
3. Accounts & Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Keep your account credentials confidential
- Notify us immediately of any unauthorised use of your account
You are responsible for all activity that occurs under your account. BuilderCam is not liable for any loss arising from unauthorised access to your account due to your failure to keep credentials secure.
4. Subscriptions & Billing
Merchant of Record
All purchases through BuilderCam are processed by Paddle.com Market Ltd. ("Paddle"), which acts as the Merchant of Record. Your contract for purchase is with Paddle. Paddle's Terms of Service and Privacy Policy apply to all transactions.
Credits & Plans
BuilderCam is a credits-based platform. Each SOW generation uses one credit. Credits can be purchased as one-time packs or through a monthly subscription plan. Current pricing is available in the app's billing section. Prices are displayed exclusive of applicable taxes, which Paddle will calculate and collect at checkout.
Billing Cycle
Subscriptions are billed in advance on a monthly recurring basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Credits purchased as one-time packs never expire.
Price Changes
We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect your current billing period. Your continued use of the Service after a price change constitutes acceptance of the new price.
5. Refund Policy
If you are not satisfied with BuilderCam, you may request a full refund within 14 days of your initial purchase or renewal date by contacting support@buildercam.ai. Refund requests after this period will be evaluated on a case-by-case basis.
Refunds are processed through Paddle and may take 5–10 business days to appear on your statement, depending on your payment method and bank.
6. Acceptable Use
You agree not to use the Service to:
- Record individuals without their knowledge or consent where required by applicable law
- Upload, transmit, or store content that is illegal, defamatory, threatening, or fraudulent
- Violate any applicable laws or regulations
- Attempt to reverse-engineer, decompile, or disassemble the Service
- Scrape, crawl, or use automated means to access the Service without our written permission
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Use the Service to create a competing product or service
- Share your account credentials with others or allow multiple people to use a single-user account
We reserve the right to suspend or terminate accounts that violate this policy.
7. Your Content
Ownership. You retain all ownership rights in the videos, documents, and other content you create using the Service ("Your Content").
Licence to us. By uploading Your Content, you grant BuilderCam a limited, worldwide, royalty-free licence to store, process, and transmit Your Content solely to provide and improve the Service. We do not use your recordings or documents to train AI models without your explicit consent.
Responsibility. You are solely responsible for Your Content and represent that you have all necessary rights and consents (including from any individuals recorded) to upload and use it through the Service.
Deletion. You may delete Your Content at any time. Upon account deletion, Your Content will be removed from our servers within 30 days, except where retention is required by law.
8. Intellectual Property
The Service, including all software, designs, trademarks, logos, and generated SOW templates, is the property of TechBacked and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal or internal business purposes in accordance with these Terms.
9. Third-Party Services
The Service integrates with third-party services including Google Firebase, OpenAI, and Paddle. Your use of those services is governed by their respective terms and privacy policies. BuilderCam is not responsible for the practices or content of third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
BuilderCam does not warrant that:
- The Service will be uninterrupted, error-free, or completely secure
- AI-generated Statements of Work are accurate, complete, or legally sufficient for any particular purpose — you are responsible for reviewing all generated documents before sending them to clients
- The Service will meet your specific requirements
Generated SOW documents are tools to assist you and should not be relied on as legal advice. Consult a qualified professional for legal matters.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHBACKED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:
- Your use of or inability to use the Service
- Any unauthorised access to or use of our servers or your data
- Any errors or omissions in AI-generated content
- Any other matter relating to the Service
IN NO EVENT WILL BUILDERCAM'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BUILDERCAM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
12. Indemnification
You agree to indemnify, defend, and hold harmless TechBacked and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, Your Content, or your violation of these Terms.
13. Termination
By you. You may cancel your subscription at any time through your account settings or by contacting support@buildercam.ai. Cancellation takes effect at the end of your current billing period; you will retain access until then.
By us. We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any reason we deem necessary to protect the Service or other users, with or without notice. We will provide notice where reasonably practicable.
Effect of termination. Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy. Sections 7, 8, 10, 11, 12, and 14 survive termination.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Delaware, and you consent to personal jurisdiction in those courts.
Notwithstanding the above, nothing in these Terms prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms. If you disagree with the changes, you may cancel your account before the effective date.
